調解與傳統法律途徑有何不同?

通過關係澳大利亞

If you’re separating or already separated, you might be wondering what your options are for working through the tough stuff like parenting arrangements, property, finances, or just finding a way forward.

For many families, Mediation, also known as Family Dispute Resolution (FDR) can be a simpler and less stressful alternative to going through the legal system. It’s also often much more affordable, since it’s government-subsidised.

We always recommend seeking legal advice, but that doesn’t mean you have to go through the entire process with lawyers. Many families choose to resolve issues through an FDR provider like us, then have their agreements reviewed or formalised by a lawyer afterwards.

Here’s how the two approaches often differ:

  • Mediation with us is designed to reduce conflict rather than escalate it. It focuses on the future and supports parents or ex-partners to reach practical agreements that work for everyone, especially children.
  • The process is tailored to your needs. We check in on safety and wellbeing and assess whether mediation is appropriate for your situation. You’ll be supported by trained professionals, and you can participate from separate rooms or locations if needed.
  • It’s significantly more affordable. Our services are government-subsidised, meaning we can offer low-cost support for people who may not be able to access private mediation or extended legal processes.

What about lawyer-led Family Dispute Resolution?

Some law firms do offer FDR and mediation services, typically delivered by accredited mediators who are also practising lawyers. While this can be a good option for some, it often comes at legal firm prices – with fees ranging from $935 to $2,750 per session. Some firms even bundle this into a complete “separation package” at a flat fee, which can still run into the thousands.

What if I’ve already engaged lawyers?

At Relationships Australia NSW, we want to make separation less stressful and more supported. Even if you’ve started down the legal route, you can still book a free Family Advisor appointment with us. It’s completely obligation-free, and you don’t need to stop working with your lawyer.

Even if you decide not to use our services, you’ll walk away with practical information about your options, and referrals to other services (like counselling), workshops and support groups that may help you navigate the separation process with more clarity and confidence, as well as deal with the more emotional side of the process.

Book a free Family Advisor appointment today by calling us on 1300 364 277, or request a call back 這裡.
